Last updated: October 7, 2026 · Version 1.2

Please read these Terms carefully. They include a limit on our liability (Section 16), an assumption of risk for physical safety (Section 7), a requirement to resolve most disputes by individual arbitration rather than in court, and a class action waiver (Section 19). They also put responsibility for guests’ consent and for the images you use on you (Sections 4, 5 and 6). You can opt out of arbitration within 30 days (Section 19).

1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you and Fuyu Labs LLC (“Fuyu Labs,” “we,” “us”) for the Fuyu Film: Photobooth app and this website (together, the “Service”). By downloading, installing or using the Service you acknowledge that you have read, understood and agree to these Terms and to our Privacy Policy. If you don’t agree, do not use the Service. If you use the Service for an organization, you agree on its behalf, and “you” includes that organization.

2. Description of the Service

Fuyu Film: Photobooth lets you take photos with the camera of an iPad or iPhone, arrange them into strips, apply frames, filters, backdrops and props, and save, share or print the result. It also provides an event mode for hosts, including a host lock, print queue and tools to add your own frames and images. Features may change over time.

3. Eligibility and responsibilities

  • You must be at least 13 to use the App. Users under 18 should have a parent or guardian’s permission, and you must be 18 or older (or the age of majority where you live) to buy an event pass or host an event.
  • You are responsible for your device, your Apple ID, your host PIN, and everything that happens through your use of the Service.
  • You are responsible for all content you create, capture, import, share, print or display, including photos of other people.
  • You must comply with all laws that apply to your use, including privacy, publicity, photography, recording and biometric laws.

4. Your content and license to us

You keep ownership of your photos, strips and designs (“Your Content”). We do not receive Your Content during normal use because it stays on your device. If you send us any of it (for example, in a support email), you give us a limited, non-exclusive, royalty-free license to use it only to respond to you, fix problems and improve the Service. You are solely responsible for backing up Your Content. We cannot recover it if it is lost, deleted or corrupted.

You promise that Your Content, and anything you capture or add, does not violate any law or anyone’s rights, and that you have all permissions and releases needed from people who appear in it. We do not monitor, review or validate Your Content, and we do not give legal advice about copyright, fair use, privacy or publicity rights. Determining those is your responsibility.

5. Custom frames, backdrops, props and footers

Hosts may add their own images, such as frames, backdrops, props and logos. By adding an image you promise that:

  • you own it or have all rights, licenses and permissions needed to use, copy, modify (for example, cutting out a subject or removing a background), display and print it, including from any person shown and from any trademark or copyright owner;
  • it does not infringe or violate anyone’s copyright, trademark, privacy, publicity or other rights;
  • it is not unlawful, hateful, harassing, sexually explicit, defamatory or harmful.

The App asks you to confirm this when you add an image. That confirmation is a legally binding statement. Automatic cutouts and background removal may be imperfect, and you are responsible for checking the result before using it with guests. Frame artwork and effects built into the App are licensed to you for use inside the App only.

6. Event hosts: guests, consent, clients and venues

If you run a booth, you, not Fuyu Labs, are responsible for your guests and their photos.

As a host you are solely responsible for:

  • notifying guests that photos will be taken, saved, printed or shared (for example, with a clear sign), and obtaining any consent required by law or by the venue, including parental consent for minors;
  • how guests’ photos are stored, exported, shared, printed and deleted, and for honoring any guest’s request to delete their photos;
  • getting any model, publicity or similar release if photos will be used for marketing, by a sponsor, in a contest or promotion, or for anything beyond giving guests their own strips, and for following the laws and rules that apply to any promotion you run;
  • your event’s content, including any text, logo, frame, backdrop or prop you add;
  • following the venue’s rules, permits, insurance and power and safety requirements, and any laws about photography at your location;
  • testing your device, camera, printer, paper, ink, network and power before the event, and having a backup plan;
  • keeping the device secure. The host PIN and lock are convenience features, not security guarantees. They may not stop a determined person, anyone who learns the PIN, force-quitting the App or turning off the device. We recommend using iPad Guided Access at events.

Professional operators. You may use the Service at events for clients, such as a professional photobooth operator. Each event needs its own pass. You are responsible to your clients and their guests (we have no obligation to them), you are responsible for their branding and designs, and you may not say or imply that you act for, or are endorsed by, Fuyu Labs.

Fuyu Labs is not a party to any arrangement between a host and guests or clients, and has no responsibility to them.

7. Physical safety and assumption of risk

You use the Service, and run any booth, at your own risk.

A photobooth involves devices, stands, cables, printers, crowds and often food, drink and children. To the fullest extent permitted by law, you assume full responsibility and liability for property damage, personal injury or death that may result from your use of the Service, your booth or your event, including equipment setup, tripping hazards, tip-overs, heat or moving parts in printers, electrical hazards, liquids, and the behavior of guests. Specifically:

  • Equipment. Use stable, secure stands and mounts, and keep cords and cables out of walkways. You are solely responsible for damage to or theft of your own devices and equipment, and to the venue’s property.
  • Supervision. Minors need active adult supervision. Parents and guardians are responsible for their children, and hosts are responsible for the booth area.
  • Environment. Don’t set up or use a booth in unsafe conditions such as storms, wet areas, extreme heat or crowded exits.
  • Emergencies. If anyone is hurt or in danger, stop using the Service, call local emergency services, and put safety first.

We recommend that hosts carry appropriate event insurance. Nothing in this section limits liability that cannot be limited by law.

8. Copyright complaints

Your photos and designs stay on your device, so we generally can’t see or remove them. If you believe the App itself, or something on this website, infringes your copyright, email synclively@gmail.com with a description of the work, where the material is, and your contact details.

9. Pricing, passes and payments

  • One Take: one free strip per calendar day on a device. Additional strips cost the price shown in the App before you shoot. A day’s free strip is counted when a strip is produced.
  • Event passes: a flat price per 24-hour block that starts when you tap “Go Live.” Additional days can be added. A pass covers one event, is single-use, and cannot be restarted, transferred or reset once the event has gone live. An event ends on its own when the purchased time runs out, and the host cannot end it early.
  • Optional extras: some features may be sold as one-time unlocks, if and when we offer them.
  • Prices are shown in the App at the time of purchase, may change at any time, and exclude taxes that may apply. Features, pricing and which features are free may change for future purchases.
  • Payments and refunds: purchases are processed by Apple through the App Store. We do not receive your payment details and cannot issue refunds ourselves. Requests for refunds go to Apple at reportaproblem.apple.com and are subject to Apple’s policies. Except where law requires otherwise, purchases are final once you tap Go Live or once a strip is produced.
  • Fair-use protections: the App uses time and usage records stored on your device to enforce pass and daily-strip rules. Attempting to bypass them, for example by changing the device clock, may cause the App to pause or restrict the booth. We are not liable for the effect of those protections, including if a device’s clock is wrong.
  • An event may stop, pause or lose time if the device clock is changed, the device is turned off, the App is closed or reinstalled, or the App has a fault. Our liability is limited as described in Section 16.

10. Printing and third-party hardware

Printing uses Apple’s AirPrint and your own printers, paper, ink and networks. We do not make, sell, support or control any printer or hardware. We make no promise that any particular printer, paper size, bridge device or network will work, or that prints will match the on-screen preview exactly in color, size or cut. You are responsible for printer settings, supplies and costs, and for the safe use of any equipment. Print jobs may be delayed, fail or be duplicated. You should check prints at the start of each event.

11. Prohibited uses

You agree not to:

  • take, store, share or print photos of anyone in violation of law, their privacy or their consent, or use the Service for surveillance, stalking or harassment;
  • capture, create or share content that is unlawful, sexually explicit involving minors in any way, hateful, threatening or infringing;
  • use the Service to identify, track or profile people, or to build facial recognition or biometric databases from photos;
  • reverse-engineer, decompile, modify, copy or resell the App, or remove its notices;
  • bypass or tamper with pricing, passes, daily limits, clock protections, the host lock or any other security feature, or share or transfer a pass;
  • interfere with the Service or attempt unauthorized access to it;
  • use the Service in a way that could injure people or damage property.

To report misuse, email synclively@gmail.com.

12. Our intellectual property

The App, including its software, design, frame artwork, filters, backdrops, props, text, name, logo and the Fuyu Film and Fuyu Labs marks, is owned by Fuyu Labs LLC or its licensors and is protected by law. We give you a limited, personal, revocable, non-exclusive, non-transferable license to use the App on Apple devices you own or control, under these Terms. We keep all other rights. You may share the strips you create with the built-in frames and effects for your own personal and event use.

13. Third-party components and services

The App is built on Apple’s frameworks (such as the camera, Vision, image processing and AirPrint) and does not include third-party advertising, analytics or tracking code. If we include any open-source component in the future, we will list it and its license here and in our Privacy Policy. Apple’s services and your printer’s services are provided by those third parties under their own terms, and we are not responsible for them. Links to other sites are for convenience only and we don’t control them.

14. Availability and technical limits

  • The Service depends on iOS, device hardware, the camera, storage, battery, network and Apple services outside our control. Updates to iOS or the App Store may change or break features.
  • Face, person and pet detection, backdrop cutouts, props, filters and automatic image processing are approximate and may be wrong, miss people or animals, cut out incorrectly, or place items oddly. They may work less well on some skin tones, lighting, clothing, poses, children, animals or devices.
  • We may modify, suspend or discontinue the Service or any feature at any time, though we will try to give reasonable notice before ending a pass in progress.
  • The App may stop working or lose data if the device runs out of storage or battery, or if the App or device crashes.

15. NO WARRANTIES

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure or free of harmful components; that it will meet your needs or work with your printer or equipment; that any photo, strip or print will be captured, saved, printed or turn out as expected; or that any event will run without interruption. You use the service, and run any event, at your own risk. Some jurisdictions do not allow certain exclusions, so some of this may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, Fuyu Labs LLC and its owners, members, officers, employees, contractors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of photos, data, profits, revenue, goodwill, event or business opportunity, wedding or event photos, bookings, or costs of replacement, printing or hiring a substitute photographer or booth, however caused and under any theory, even if we were told they might happen. This includes damages arising from lost, missing, corrupted or unprinted photos; a device, printer, network or app failure or crash; an event that paused, ended early or did not run; claims by your guests, clients or any third party; or injury or property damage at your event.

Our total liability for all claims relating to the service will not exceed the greater of (i) the amount you paid us for the service in the 12 months before the claim arose, or (ii) US $100.

These limits apply to the fullest extent permitted by law and do not exclude liability that cannot be excluded by law (such as for fraud or, where applicable, for death or personal injury caused by our negligence). The limits are an essential basis of the bargain between us.

17. Indemnification

You agree to defend, indemnify and hold harmless Fuyu Labs LLC and its owners, officers, employees, contractors and licensors from any claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of or related to: your use or misuse of the Service; Your Content or any image you add; photos you or your guests take, share, print or publish; any event you host or any client you serve, including claims by guests, clients, venues or other third parties (for example, privacy, publicity, biometric, consent, injury or property-damage claims); your violation of these Terms or the law; or your infringement of any third party’s rights.

18. Termination

You may stop using the Service at any time by deleting the App. We may suspend or end your access or license at any time, with or without notice, if we believe you have violated these Terms, are misusing passes or the Service, are engaged in fraud, or if the law or Apple requires it, or if we discontinue the Service. Because the App has no account system and we have no ability to remotely disable a specific installation, in practice this means the App ceasing to function for you, for example through a future update. Sections that by their nature should survive (including 4, 5, 6, 7, 9, 12, 15, 16, 17, 19, 20 and 24) survive termination.

19. Dispute resolution, arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

  • Informal resolution first. Before starting a claim, email synclively@gmail.com describing the dispute, and give us 30 days to try to resolve it in good faith.
  • Binding arbitration. Except as described below, you and Fuyu Labs agree that any dispute arising out of and relating to these Terms will be resolved by final, binding individual arbitration before a single arbitrator administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at adr.org), rather than in court, and without a judge or jury. The arbitrator may award the same individual relief a court could. The arbitration may be conducted by phone, video or written submissions, or in person in your county of residence. Judgment on the award may be entered in any court that has jurisdiction.
  • Scope. This arbitration agreement covers only claims arising out of and relating to these Terms. It does not cover other claims, such as a claim for injury at an event that doesn’t arise out of and relate to these Terms. To the extent the law allows, the arbitrator, and not a court, decides whether a claim is covered, except that a court decides whether the class action waiver is enforceable.
  • Fees. Fuyu Labs will advance the AAA filing and arbitrator fees up to US $5,000, and the arbitrator may reallocate fees as the AAA rules and law allow (for example, if a claim is found frivolous).
  • Exceptions. Either party may bring an individual claim in small-claims court (including in your county of residence) if it qualifies. Claims about infringement or misuse of intellectual property, requests for injunctive or equitable relief to protect or enforce a party’s intellectual property or to enforce these Terms, complaints to a government agency, and any claim that the law does not allow to be arbitrated, are not subject to arbitration.
  • Class action waiver. You and Fuyu Labs may bring claims only in your or its individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not combine claims or preside over any class or representative proceeding. If this waiver is found unenforceable as to a claim, that claim will go to court and not arbitration, and the class waiver and arbitration provisions are not severable from each other.
  • 30-day opt-out. You may opt out of arbitration by emailing synclively@gmail.com within 30 days after you first accept these Terms, with the subject “Arbitration opt-out” and your name and the email address you use with the App. If you opt out, the rest of these Terms still apply.
  • Time limit. To the extent permitted by law, any claim must be brought within one (1) year after it arose, or it is permanently barred.

20. Governing law

These Terms are governed by the laws of the State of California and the Federal Arbitration Act, without regard to conflict-of-law rules. For any claim not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in California, and waive objections to that venue. If you are a consumer, mandatory consumer-protection laws of the place where you live still apply where they give you greater protection.

21. Apple terms

  • These Terms are between you and Fuyu Labs, not Apple. Apple is not responsible for the App or its content, maintenance, support or warranties. If the App fails to conform to a warranty, you may tell Apple to refund the purchase price, and Apple has no other warranty obligation. As between you and us, we are responsible for claims about the App, including product liability, legal or regulatory compliance and intellectual property.
  • We, not Apple, are solely responsible for providing any maintenance and support for the App (see our Support page). Apple has no obligation to provide any. Questions, complaints or claims about the App can be sent to Fuyu Labs at synclively@gmail.com. If any third party claims that the App infringes its intellectual property rights, we, not Apple, are solely responsible for investigating, defending and settling that claim.
  • You must follow the Apple Media Services Terms and the usage rules of the App Store, and any third-party agreements that apply when you use the App, such as the terms of your internet or wireless data provider and your printer’s manufacturer. You confirm you are not located in a country subject to a U.S. embargo or designated a “terrorist-supporting” country, and are not on a U.S. list of prohibited parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

22. Changes to these Terms

We may update these Terms from time to time. For material changes we will give at least 30 days’ notice in the App, on this page or by email, and will update the date above. Changes take effect on the stated date for new purchases and, for existing use, after that notice period unless the law requires otherwise. Continuing to use the Service after that means you accept the updated Terms. If you don’t agree, stop using the Service.

23. International use and regional terms

The Service may be available in many countries through the App Store. Nothing in these Terms limits any mandatory consumer-protection right you have under the law of your own country. In particular:

  • EU/UK: consumers keep their mandatory rights, which may include withdrawal and cooling-off rights for digital content, and nothing in the arbitration section limits those statutory rights.
  • Australia: nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, and our liability limits are subject to the Competition and Consumer Act 2010.
  • If a mandatory local rule conflicts with these Terms, that rule applies to you to the extent required.

24. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
  • Severability. If a provision is unenforceable, the rest stays in effect (except as stated in Section 19).
  • No waiver. Not enforcing a provision is not a waiver of it. A waiver by us is effective only if in writing.
  • Assignment. You may not transfer these Terms or your rights. We may assign them, including in a merger or sale of the business, and they bind successors and permitted assigns.
  • Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages of Apple services, the internet or power, natural disasters, war and acts of government.
  • Export. You must follow all applicable export and sanctions laws.
  • Not a professional service. The Service is not a substitute for a professional photographer. Do not rely on it as the only record of an event you cannot repeat.
  • Notices. We may give notice by email, in the App or on this page.
