Fair terms that describe exactly what Etudia does today, protect your imported content, and set clear expectations for both of us.
By downloading, installing, accessing, or using Etudia ("Service," "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.
Binding Agreement: These Terms constitute a legally binding agreement between you and Fuyu Labs LLC ("Fuyu Labs," "we," "us"). They should be read together with our Privacy Policy.
Etudia is a piano sight-reading practice tool for Apple devices, providing:
What Etudia is not (yet): Etudia does not currently listen to your playing, accept MIDI or audio input, or grade your performance against the score. It is a visual and audio practice aid, not a performance-assessment tool. Any such capability, if introduced in the future, will be described here before it ships.
Personal Use: The Service is intended for personal, non-commercial practice and educational use.
Etudia does not require an account and is available to a general audience, including students practicing under a parent's or teacher's supervision. If you are under the age of majority in your jurisdiction, you should have a parent or guardian's permission to accept these Terms and make any in-app purchase.
Etudia does not inspect, review, or validate imported files for copyright status; determining whether your use is lawful is your responsibility. Imported files are processed and stored on your device only — see our Privacy Policy for details.
The underlying musical works in Etudia's curated library — compositions by historical composers such as Bach, Beethoven, Satie, Clementi, and Burgmüller — are in the public domain and are not owned by Fuyu Labs or anyone else. The specific digital engravings we've prepared from public-domain sources, along with any original studies and app software, design, and curated selections, are owned by Fuyu Labs LLC. You may use curated content for personal practice within the app; you may not extract, redistribute, or republish our specific engravings or original studies outside the app for commercial purposes.
Etudia offers a free tier and an optional premium unlock (monthly, annual, or lifetime), billed entirely through Apple's In-App Purchase system. Pricing shown at checkout in the App Store is authoritative and may vary by region and change over time.
"Lifetime" access means access for the longer of (a) your natural life, or (b) five (5) years from the date of purchase, subject to the Service's continued technical feasibility. If a core feature becomes impossible to support due to a platform change outside our control, we may offer a pro-rated refund in lieu of continued access.
Refunds, cancellations, and subscription management are handled by Apple per its own policies — Fuyu Labs cannot directly process a refund on Apple's behalf.
Not a substitute for instruction: Etudia is a self-directed practice tool. It does not replace a piano teacher and makes no claim to.
No outcome guarantees: We make no warranty that using Etudia will result in any particular skill level, reading speed, or musical outcome.
Notation & audio accuracy: Curated pieces are re-engraved from source material by hand and cross-checked, but transcription errors are possible; the audio preview is a synthesized approximation of a piano, not a substitute for hearing the piece performed live.
Etudia depends on Apple's iOS/iPadOS platform and may be affected by OS updates, device compatibility, and App Store policy changes outside our control. We do not guarantee uninterrupted or error-free operation.
Etudia's notation rendering is powered by Verovio, used under the GNU Lesser General Public License v3.0. Its use does not transfer any of Etudia's own software, design, or curated content into that license — only Verovio itself remains governed by its own license terms. You agree not to:
Etudia's software, design, original studies, and curated-library engravings are owned by Fuyu Labs LLC and protected by applicable intellectual property law, except for third-party open-source components (§9) and public-domain musical works (§5), which remain governed by their own status.
DMCA: If you believe content within Etudia infringes your copyright, contact synclively@gmail.com with sufficient detail to identify the work and the claimed infringement.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the fullest extent permitted by law, Fuyu Labs LLC's total liability for any claim arising from your use of the Service shall not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim, or (ii) USD $100. Fuyu Labs is not liable for indirect, incidental, consequential, or punitive damages.
You agree to defend, indemnify, and hold harmless Fuyu Labs LLC from claims, damages, or expenses arising from your use or misuse of the Service, content you import, your violation of these Terms, or your infringement of a third party's rights.
Your rights: You may stop using the Service at any time by deleting the app.
Our rights: We may suspend or restrict access for violation of these Terms, suspected fraud, or as required by law. Because Etudia has no account system, "termination" in practice means the app ceasing to function for you, e.g. via a future update — we have no ability to remotely disable a specific installation today.
Except for claims eligible for small-claims court, any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
You may opt out of this arbitration agreement by emailing synclively@gmail.com within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where mandatory consumer-protection law of your own jurisdiction provides greater protection, in which case that law applies to the extent required.
We may modify these Terms; for material changes, we'll provide at least 30 days' notice via in-app notice and/or the contact email on file. Continued use after the effective date of a change constitutes acceptance.
Etudia may be used internationally, though primary support is provided in English. Nothing in these Terms limits any mandatory consumer-protection right you have under the law of your own country, including EU/UK withdrawal rights or guarantees under the Australian Consumer Law, which continue to apply where applicable.
Entire Agreement: These Terms, together with the Privacy Policy, are the entire agreement between you and Fuyu Labs regarding the Service.
Severability: If any provision is found unenforceable, the rest remains in effect.
No Waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
