- Study analytics and personalized learning recommendations
Personal Use Only: The Service is intended for personal, non-commercial educational use only.
3. User Accounts, Eligibility & Responsibilities
Age Requirement: You must be at least 13 years old to use this Service. Users under 18 should have parental supervision.
Account Security: You are responsible for:
- Maintaining the security of your device and Apple ID
- All activity that occurs through your use of the Service
- Immediately notifying us of any unauthorized access or security breach
- Providing accurate information when configuring the app or contacting support
4. Content Import & User Responsibilities

You represent and warrant that for all content you import:
- You own the content OR have explicit permission to use it for personal educational purposes

- You will not import content that is illegal, harmful, or violates platform policies

4B. Content Processing Limitations
Technical Disclaimers:
- Text recognition accuracy varies by document quality and language complexity
- Dictionary definitions and translations are provided for reference only and may contain errors
- We do not guarantee accuracy of any automated processing features
- Processing capabilities may be limited by device performance or iOS restrictions
5. Curated Content & Licensing
Our Content: Educational materials provided by Fuyu Labs LLC are licensed to you for personal use only. You may not:
- Redistribute, share, or republish our curated content
- Use our content for commercial purposes
- Modify or create derivative works from our educational materials
- Remove copyright notices or attribution
6. Subscription & Payment Terms
Freemium Model:
- Free tier: Limited document imports (1 document) and vocabulary saves (30 words)
- Premium subscription: Unlimited imports, saves, and access to all features
- Billing handled entirely through Apple In-App Purchase system
Lifetime Access Terms:
- "Lifetime" means the longer of: (a) your natural life, or (b) five (5) years from redemption
- Subject to Service continuity and technical feasibility
- If core features become technically impossible due to OS changes, we may offer pro-rated refunds
7. Educational Disclaimers & Limitation of Learning Outcomes
- Not Professional Instruction: Bamboo Reader is a self-study tool and does not replace professional language instruction
- No Learning Guarantees: We make no warranties regarding language proficiency improvement or learning outcomes
- Translation Accuracy: All dictionary definitions and translations are provided "as-is" without accuracy warranties
8. Technical Limitations & Service Availability
iOS Dependency: App functionality depends on Apple's iOS platform and may be affected by:
- iOS updates that modify or remove required APIs
- Device compatibility and performance limitations
- Apple's App Store policies and continued availability
- iCloud service availability for sync features
9. Prohibited Uses & Content Restrictions
You agree not to:
- Import content you do not own or lack permission to use
- Use the Service for any unlawful purposes or to violate others' rights
- Attempt to reverse-engineer, modify, or circumvent app security features
- Share premium features with non-subscribers or attempt account sharing
- Interfere with the Service's operation or attempt unauthorized access
10. Intellectual Property Rights
Our Rights: Bamboo Reader, including all software, design, curated content, and related materials are owned by Fuyu Labs LLC and protected by intellectual property laws.
DMCA Compliance: We respect intellectual property rights. If you believe content infringes your copyright, contact synclively@gmail.com with appropriate documentation.
11. NO WARRANTIES & DISCLAIMERS
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12. Limitation of Liability
MAXIMUM LIABILITY CAP: TO THE FULLEST EXTENT PERMITTED BY LAW, FUYU LABS LLC'S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (i) Amounts you paid us in the past 12 months, or (ii) USD $100
13. Indemnification
You agree to defend, indemnify, and hold harmless Fuyu Labs LLC from any claims, damages, or expenses arising from:
- Your use or misuse of the Service
- Content you import or create using the Service
- Violation of these Terms or applicable laws
- Infringement of third-party intellectual property rights
14. Account Termination
Your Rights: You may stop using the Service at any time by deleting the app from your devices.
Our Rights: We may suspend, restrict, or terminate your access for violation of these Terms, suspected fraudulent activity, or legal requirements.
15. Dispute Resolution & Arbitration
Mandatory Arbitration (With Exceptions)
Binding Arbitration: Except for small claims court, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
30-Day Opt-Out Right
You may opt out of arbitration by sending written notice within 30 days to: synclively@gmail.com
16. Governing Law & Jurisdiction
Primary Governing Law: These Terms are governed by California state law, without regard to conflict of law principles.
Consumer Protection: Mandatory consumer protection laws of your country or state continue to apply where they provide greater protection.
17. Modifications to Terms
Change Process: We may modify these Terms with 30 days advance notice via in-app notification and/or email for material changes.
Acceptance: Continued use after the effective date constitutes acceptance of modified Terms.

The following regional provisions supplement these Terms upon official Service launch in each territory:
EU/UK Launch
- EU consumers retain mandatory withdrawal/cooling-off rights
- Nothing in these Terms limits statutory consumer protection rights

20. Entire Agreement & Severability

Severability: If any provision is found unenforceable, the remainder remains in full effect.
Effective Date: These Terms become effective upon your first use of Bamboo Reader
